    Ebay's Prohibited Items Policy

I know this sort of thing had been discussed before, but can you believe ebay are still removing items for no real reason other than what appears to be them imposing their own moral code.

I had my listing for Nekromantik removed and when I emailed them I got this response

"Although "Nekromantik" is not an adult video, it does contain some very
strong mature content. We realize that it is legal in the UK to sell
this item, but eBay has chosen to end this film on the grounds of the
demeaning nature of the movie. eBay also bans movies such as "I Spit On
your Grave", "Jaded", "Ken Park", "Baise Moi", "Bum Fights", and
    "Executions". "

This isn't the first time i've had a listing pulled, they also removed my listing for Faces Of Death, a few months back. What I really suprised about is the fact they state Nekromantik is not an adult video and is legal to sell in the UK, yet they removed it anyway. I know other people have had problems in the past with Box Of The Banned. Is anyone else still having listings pulled for no real reason?

They even pulled Ken Park and Baise Moi? Wow, I guess yanks are too sensitive to sex.

Ebay pulled my listing of a 'PC USB Light Gun' and didn't respond to my protests about it.

I can understand how they need to cover their backs legally, but it's a little rough when they ban the likes of Executions - which is available without question uncut in the UK - purely because it may offend.

They have people flogging Barbie dolls, which I find offensive. Do I have grounds for getting those removed from sale?

As a whole, Amazon’s business model is far superior to eBay’s in relation to third party sellers as it adheres to the rules of the free market; plus you have more comeback if anything goes wrong. Unfortunately it’s limited to their listings on what you can sell.

The whole Ebay/Paypal thing has always bothered me; they shouldn’t be allowed to run both in parallel as it creates a conflict of interest in regards to the customer’s rights.

I haven't bought anything from Ebay for ages ever since I was in dispute with them over a stupid issue. Get this - they REFUSED to email me in English because my IP address at the time was rom Germany. No, seriously.

But why get upset? They can do what they want in their own little sandpit.

Anyway - is Nekromantic legal in the UK - has it been through the golly BBFC?

Regardless, just don't use them - their customer service is terrible.

I doubt the BBFC would pass it, even in an cut state.

I also had KEN PARK listing removed on the UK site. Last time I looked, this film was listed in several auctions on the American site.

Then technically, it's not "legal", right?

It's not legal at all to sell copies of Nekromantik in the UK.

Totally off topic here, but you’ve got to love this bit of trivia about Ken Park on Wikipedia:

The movie was not shown in the United Kingdom after director Larry Clark punched and attempted to strangle Hamish McAlpine, the head of the UK distributor for the film, Metro Tartan. Clark was arrested and spent several hours in custody, and McAlpine was left with a broken nose.

Register as a seller on ebay.com instead of co.uk and you can sell as many of Nekromantik as you like

Yep, remember this. Had a ticket to see KEN PARK at the London Film Festival and we found out it had been pulled just beofre we went in to see AUTOFOCUS, a few hours before KEN PARK was due to start.

    Re: Ebay's Prohibited Items Policy

I knew Nekromantik hadn't been certified by the BBFC, so I wasn't sure whether Ebay's comment regarding selling it in the UK was or not. I actually bought the dvd from Hogshead Music in Edinburgh (they had it out on display in their second hand section, along with the unrated R1 release of Caligula!)

I always thought the law stated it's ok to import items for private use, so i fail to see why me selling it via ebay really should be a problem, when the same buyer can import it direct from the States themselves. Suffice to say when I completed their feedback survey, I gave a frank and full explanation regarding my problem with their rules (Though I doubt it will make a difference!) Actually, i've also noticed other people's UK listings for Nekromantik 2 have also been pulled, so i'm not the only one with this problem!

    Re: Ebay's Prohibited Items Policy

You're selling it - so it's not private use. If the laws that be could be bothered, they could have it removed from that store in Ediburgh as well.

Not saying I agree with all this, but they do have a point.

Technically, that law should apply to all uncertified movies that are resold - from Mary Poppins to Flowers Of Flesh and Blood.

However, because eBay is flooded with resold imports, they only tend to pick on the notorious ones. The rule of thumb is that if it’s released in this country in any form, then the listing is less likely to get pulled.
